Resumen : La Consulta Previa es un derecho establecido por la Constitución para las comunidades, pueblos y nacionalidades indígenas; tiene el objetivo de garantizar el consentimiento previo, libre e informado de estos grupos. Es un derecho que actúa sobre la realización de proyectos que pueden afectar territorios ancestrales y milenarios, habitad natural, cultura, forma de gobierno, integridad física y mental, derecho colectivo a la vida, derecho de participación y de autodeterminación, por lo tanto, la decisión que tomen en torno al ejercicio y protección de sus derechos es y debe ser totalmente vinculante para el Estado. Sin embargo, el gobierno ecuatoriano no asegura interpretación adecuada de las leyes internacionales dando paso a la exploración y explotación en los bloques 31 y 43 del Parque Nacional Yasuní ITT, a pesar de la oposición de los pueblos indígenas que habitan y de las pruebas de avistamiento de pueblos en aislamiento voluntario. En este sentido el presente trabajo de tesis busca analizar si el Art. 57 de la Constitución que contiene el derecho de consulta previa se cumplió a cabalidad o si se lo ha vulnerado creando una responsabilidad histórica con estos pueblos. Para tales fines, se utilizó tanto fuentes primarias como secundarias de información y la metodología fue de orden analítico, bibliográfico y técnicas de campo.
Descripción : Prior consultation is a duty imposed by the Constitution for communities, peoples and nations; aims to ensure the free, prior and informed consent of these groups. It is a right which acts on the implementation of projects that may affect ancestral and ancient territories, natural habitat, culture, governance, physical and mental integrity, collective right to life, right to participation and self-determination, therefore the decision take on the exercise and protection of their rights is and must be fully binding on the State. However, the Ecuadorian government does not ensure proper interpretation of international law giving rise to the exploration and exploitation in blocks 31 and 43 of the ITT Yasuní National Park, despite the opposition of the indigenous peoples living and evidence of sighting of peoples in voluntary isolation. In this sense, this thesis seeks to analyze whether the Art. 57 of the Constitution contains the right to prior consultation was fully achieved or if it has been violated by creating a historical responsibility to these people. To that end, both primary and secondary sources used for information and analytical methodology was, bibliographic and technical field order.
