Resumen : El Sistema de Administración de Justicia en Ecuador se ha visto limitado en el cumplimiento de sus objetivos debido a la crisis por la que atraviesa. Ecuador se reconoce como un país en el que existen altos índices de litigiosidad, y es por ello que se necesita adoptar medidas que no solo beneficien al sistema, sino también a los usuarios, ya que la ciudadanía percibe que el sistema de justicia no responde de manera oportuna a las necesidades ciudadanas. Frente a esta problemática, se origina un reto que atañe tanto al sistema judicial como a la ciudadanía, y es el de adoptar mecanismos extrajudiciales de solución de conflictos. Se propone, entonces, el contemplar a los Centros de Mediación como una opción eficaz, a través de la reforma de la Ley de Arbitraje y Mediación vigente; basándose en la experiencia argentina, referente latinoamericano respecto al tema, misma que ha marcado una tendencia para resolver los conflictos de manera positiva al utilizar, de forma obligatoria, la mediación como herramienta que antecede a cualquier proceso judicial.
Descripción : The System of Administration of Justice in Ecuador has met limited in the fulfillment of his aims, due to the crisis for that crosses. Ecuador is established as a country in which there are high rates of litigation, is why is need to take measures that will not only benefit the system but also to the users, because the public perceives that the justice system does not respond in a timely manner to needs of citizens. Faced with this problem, originates a challenge that concerns both the judiciary and the public, and is to adopt extrajudicial dispute resolution mechanisms. We propose, then, to consider Mediation Centers as an effective option, through the reform of the Law on Arbitration and Mediation; based on the Argentinian experience, Latin American reference on the subject, which has marked a trend to resolve conflicts in a positive way by using, mandatorily, mediation as a tool that precedes any prosecution.
