| dc.description | The present work deals with the criminal liability of legal persons focused on crimes against the environment, addressing such topics as the evolution of the concept of legal person in different societies, and how each of these has been recognizing its act in community life. It addresses the theory of crime into account imputation model that was applied in order to blame and therefore accountable to the legal person. Similarly offers a range of sentences that meet the purposes of the theory of punishment. An analysis of how the criminal act of the legal person may damage legal rights groups, focusing on crimes against the environment. Contains a proposed amendment to two chapters of the Penal Code, the first reform is the inclusion of the criminal liability of legal persons and the second reform is to reconcile the environmental offense, for the record as the subject of corporate crime. The objective of this research was based mainly on finding a model whereby a utopia is not the charge of the legal person and allow a harmonious integration of the proposals submitted to national criminal law. The research results show that it is possible to criminalize a legal person, by means of a special type of complaint, which meets the requirements of conscience and will also add specific elements that allow a precise legal responsibility of the person, avoiding a confusion between a crime committed by this and one committed by a natural person, who has used this legal institution. | en |
| dc.description.abstract | El presenta trabajo trata sobre la responsabilidad penal de las personas jurídicas enfocada en los delitos contra el medio ambiente, se abordan temas como la evolución de la concepción de la persona jurídica dentro de distintas sociedades, y como cada una de estas ha ido reconociendo su actuar dentro de la vida en comunidad. Aborda la teoría del delito en cuento al modelo de imputación que se ha aplicar para poder culpar y por ende responsabilizar a la persona jurídica. De igual manera propone una gama de penas que cumplen con los fines de la teoría de la pena.
