dc.descriptionFundamental rights are the basis of every legal system. In Ecuador, the Buen Vivir Rights (Good Living) are considered fundamental rights and are recognized as such in the Ecuadorian Constitution of 2008. The Buen Vivir concept is a way of life originating from the ancient philosophical concept of Sumak Kawsay. The Buen Vivir and Sumak Kawsay concepts are mistakenly used as synonyms, but have two different meanings. Ecuador has adopted as its top priority to achieve the Buen Vivir of all citizens and this may cause a conflict with bilateral investment treaties (BITs), since they encourage and protect foreign investment. This paper aims to present a thorough analysis of the points of compatibility and incompatibility between the Buen Vivir, addressed in the National Buen Vivir Plan and the BITs. Therefore, first it clearly defines Buen Vivir and Sumak Kawsay, presenting and explaining the difference between the two, and later analyzing the compatibility thereof with the BITs and the alleged need of foreign investment for development. In this manner, doctrine concerning issues with fundamental rights, Buen Vivir, and BITs is studied. Furthermore, this paper analyzes arbitral awards and the logic behind them. It studies in depth the objectives of the National Buen Vivir Plan and contrasts them with the goals of the BITs. It also considers the ideological concepts of Buen Vivir and Sumak Kawsay from an anthropocentric perspective and this research delves into the real and palpable change of the paradigm in Ecuadorian society. Lastly, this paper concludes with several points of compatibility and tensions between Buen Vivir and BITs. It contributes to the academia since it leaves the door open for further and deeper discussion on transcendental and controversial matters and issues. In addition, this research demonstrates the misconceptions not recognized in the implementation of public policies in pursuit of Buen Vivir and covers new issues that were ignored prior to the completed research.en
