dc.description | The Constitution of the Republic of Ecuador in 2008 became an important advance in constitutional field, it is set within the parameters of State Constitutional of Rights, which calls for the recognition, promotion and guarantee of constitutional rights and the fundamental principles established in Montecristi. One axis that runs through the 2008 Constitution is Sumak Kawsay, which is a model originated in the indigenous world view that proposes a harmonious relationship between humans and nature. The Constitution establishes it as the Good Living. The rights of indigenous communities have taken a significant presence in the theoretical and normative framework of society as well as the rights of nature. The Development Regime that protects the Constitution guarantees the enjoyment of rights, respect for cultural diversity and harmonious coexistence with nature. The extractive activities in the Ecuadorian Amazon cause serious impacts on indigenous communities and strong socio - environmental conflicts involving indigenous people: Tagaeri - Taromenane. For this reason, legal sociology will allow analysis of the implications and relationships that determine the enforceability of the rights and the mechanisms of participation proposed to set limits on the power, and effective links in order to ensure efficacious enforcement of the norm that protects uncontacted tribes. | en |
