Descripción : Trademark generalization is perhaps the mode of trademark law extinction with more variability, therefore the hardest to stop or chase. The means to circumvent it, or corner it are complicated, and these find deeper accentuation since the cancellation due to trademark generalization has not been regulated by anything else than by default rules afterwards December 1st, 2000, when The Decision 486 of the Commission of the Andean Community came into force. Ever since, its articles 169 and 170 are the only ones that institute the legal process. Pursuant to the preponderant need of regulating the cancellation actions procedural gaps, and furthermore, according to the urgency of solving the consequences of its lack of regulation -verified mainly by the unjustified long-drawn-out process in the only raised case in the Republic of Ecuador (Process that lasted over 5 years.) which nature should have been of a summary procedure-. We set the goal of analyzing the trademark generalization and the contradistinction of the trademark owners intellectual property rights whose trademark had allegedly become the generic name for the good or service, and those of their counterpart, who needed the same registered trademark to identify their product on the market. Then, we will propose recommendations for a regulatory provision to the legal process of cancellation due to trademark generalization, in order to protect both parties rights; given the procedural gaps of the current legal regime
