dc.descriptionThis research work analyzes the rights and obligations of the figure of “Political Asylum”, from the perspective of the International Protection of people whose life, integrity and freedom are in danger. This figure requires study because it is not recognized in any other regional or universal asylum system, other than within the framework of the International Law of the Latin American Regime. That is, it does not generate rights and obligations for States that have not submitted to its norms or customs. Thus, this mechanism is reduced to a practice of the Latin American States. Therefore, a legal problem is generated when protection is granted in the territory of a State that does not belong to this regime. For example, the political asylum of Julian Assange in the Embassy of Ecuador in the United Kingdom. Therefore, this work indicates: How did the Ecuadorian State comply with the obligations of the political asylum of Julian Assange? To this end, a comparative study of the doctrine and norms that regulate asylum is carried out from two approaches: Latin American Asylum and Inter-American Asylum. Likewise, it conducts a review of jurisprudence and analysis of relevant cases regarding refuge and asylum in both regimes, with the aim of detailing the rights that people in need of international protection have. With this investigation, it is concluded that in the case of Assange Ecuador did not breach his obligations while his asylum lasted, that is, until he obtained his naturalization. In addition, there is an excess in the responsibilities of this State by giving this asylee "privileges", with which other people in similar conditions do not have. In short, political asylum is an old practice in Latin America prior to the Right of Refuge, which needs a deep normative development that ensures fair and efficient procedures for the safeguarding of the rights of people in need of International Protection.en
dc.description.abstractEl presente trabajo de investigación, analiza los derechos y obligaciones de la figura del “Asilo Político”, desde la óptica de la Protección Internacional de las personas cuya vida, integridad y libertad se encuentran en peligro. Esta figura, requiere ser objeto de estudio porque no es reconocida en ningún otro sistema regional o universal de asilo, que en el marco del Derecho Internacional del Régimen Latinoamericano. Es decir, no genera derechos y obligaciones para los Estados que no se han sometido a sus normas ni costumbre. Así, este mecanismo, se reduce a una práctica de los Estados latinoamericanos. Por lo cual, se genera un problema jurídico cuando se otorga protección en el territorio de un Estado que no pertenece a este régimen. Por ejemplo, el asilo político de Julian Assange en la Embajada de Ecuador en el Reino Unido. Por lo tanto, el presente trabajo señala: ¿Cómo el Estado ecuatoriano, cumplió con las obligaciones del asilo político de Julian Assange? Con esta finalidad, se realiza un estudio comparativo de la doctrina y normas que regulan el asilo desde dos enfoques: el Asilo Latinoamericano y el Asilo Interamericano. De igual manera, efectúa una revisión de jurisprudencia y análisis de casos relevantes en cuanto a materia de refugio y asilo de ambos regímenes, con el objetivo, de detallar cuáles son los derechos que tienen las personas en necesidad de protección internacional. Con esta investigación, se llega a la conclusión, que en el caso de Assange Ecuador no incumplió con sus obligaciones mientras duró su asilo, es decir, hasta que obtuvo su naturalización. Además, se observa una extralimitación en las responsabilidades de este Estado al entregar a este asilado “privilegios”, con los cuales, no cuentan otras personas en condiciones similares. En definitiva, el asilo político es una práctica antigua en Latinoamérica anterior al Derecho de Refugio, la cual, necesita un desarrollo normativo profundo, que asegure procedimientos justos y eficientes para el resguardo de los derechos de las personas en necesidad de Protección Internacional.es_ES
