Descripción : The present academic work tries to demonstrate through a theoretical-descriptive analysis the inadequate application of the personal precautionary measures that are not of ultima ratio enunciated in Article 522 of the Comprehensive Organic Criminal Code, warning of the abusive use of preventive detention that currently It is produced in Ecuador by the administrators of Justice, causing overcrowding and prison overcrowding. In order to ensure the presence of the processed person and not to leave the result of the trial illusory, the judges order this measure disproportionately, without sufficiently motivating it, which is contradictory to Article 534 of the COIP that deals with the requirements of prison preventive, in which according to the reform promulgated by the Official Registry No.107 that has been in force since June 24 of this year 2020, the Judge must obligatorily motivate his decision and explain the reasons why the other precautionary measures are insufficient. All precautionary measures of a personal nature are provisional and are used only as an instrument of criminal proceedings, all limit the freedom of the indicted individual, but preventive detention totally makes this fundamental right impossible, for which it is determined that their application is extremely harmful to the prosecuted subject, being thus, that before issuing it the Judge in addition to exhaustively analyzing compliance with the requirements, must take into account the basic guarantees appreciated in articles 76 and 77 of the Constitution of the Republic of Ecuador, in addition to the principles pertinent legal regulations, also the norms established by international organizations regarding this measure and their jurisprudence. Concluding then, that the objective of this academic essay is to determine that preventive detention is not an anticipated penalty, given that if after the trial is held, the innocence of the accused is confirmed, he will not be able to recover the time he spent in a prison, nor all the rights that he enjoyed before this precautionary measure, he will not even be able to access legal compensation for all the damages and losses caused to him, which is what is recommended to establish in this academic work.
