Resumen : El presente ensayo pretende realizar un acercamiento al problema jurídico existente dentro de la figura de las servidumbres administrativas, particularmente aquellas de carácter gratuito, que son cargadas por razón de utilidad pública en beneficio de la colectividad, y que, consecuentemente limitan el derecho individual de aquellos a quienes se les impone. Por tanto, la presente investigación tiene como objetivo general revisar las funciones asignadas a nivel constitucional al derecho de propiedad, mismas que, a su vez se traducen en limitaciones. Para llegar a ello, iniciaremos realizando un análisis de la evolución del derecho de propiedad en la Constitución de la República del Ecuador, pasando por las limitaciones del mismo; apartando un capítulo exclusivamente para revisar la figura de las servidumbres administrativas como institución que afecta derechos subjetivos y su carácter de inminente indemnización, tema que será revisado tomando en cuenta el caso EPMAPS que fue judicializado (PORRAS Vs. EMAAPQ.)
Descripción : This essay aims to make an approach to the existing legal problem within the figure of administrative easements, particularly those of a free nature, which are charged for reasons of public utility for the benefit of the community, and which consequently limit the individual right of those to whom it is imposed. Therefore, the general objective of this research is to review the functions assigned at the constitutional level to property rights, which, in turn, translate into limitations. To achieve this, we will begin by conducting an analysis of the evolution of property rights in the Constitution of the Republic of Ecuador, passing through its limitations; setting aside a chapter exclusively to review the figure of administrative easements as an institution that affects subjective rights and their nature of imminent compensation, an issue that will be reviewed taking into account the EPMAPS case that was prosecuted (PORRAS v. EMAAPQ.)
