| Descripción : | The purpose of this research work is to analyze the proportionality of the penalties in the crime of animal trafficking established in art. 247 of the Comprehensive Organic Criminal Code-COIP-which is considered the main illegal commercial activity after the sale of weapons and drugs in the world. Although the Constitution of Ecuador obliges the State to protect endangered species, this essay will show that the penal sanction is not proportional for this type of crime since the penalties, as they are contemplated, do not allow the effective protection of the legal right "Wild species" as an element of nature. This essay aims to demonstrate the need to seek a legal solution that allows limiting the extinction of threatened, migratory and endangered species through effective criminal protection. For this, comparative law will be used in order to determine the way in which other laws such as Mexico and Colombia establish the penalty of trafficking in wild animals according to certain technical parameters that will be analyzed throughout this investigation. |
