Resumen : Cuando me encontraba realizando mis prácticas profesionales en la empresa Lexis S.A. dentro del área de soporte de chat recibí una consulta en la que me preguntaban cuál es el tipo penal sobre el cual debía fundamentarse una denuncia por el contagio de enfermedades de transmisión sexual (ETS), y para mi sorpresa después de una investigación dentro de la legislación penal ecuatoriana descubrí que, no existe el tipo penal de contagio doloso como tal dentro del Código Orgánico Integral Penal...
Descripción : When I was doing my pre-professional practices at Lexis’s company within the chat support area, I received a question asking me what is the criminal type to report the malicious transmission of sexually transmitted diseases. However, to my surprise after an investigation in the Ecuadorian criminal legislation I discovered that there is no criminal type of malicious contagion as such within Código Orgánico Integral Penal. This experience shocked me and deeply outraged because there are a lot of cases of malicious contagion of STDs that are presented every day and cannot be reported as they are not considered an autonomous criminal type; as a consequence, a serious violation of human rights originates, mainly from the right to sexual health for the victim and impunity for their aggressor since, there is no penalty against the aberrant illegal act perpetrated. Consequently, this legal vacuum encouraged me to look for mechanisms to defend the right to health in its entirety. For this, the ideal method is international human rights law. The reason is that, by means of international treaties, States are obliged to protect the rights of human beings, which if they are breached, international responsibility arises. Therefore, the States must carry out all the necessary actions to guarantee the right, this includes the elaboration of a criminal type as proposed in this academic essay. The main reason that motivated me to elaborate this essay is the level of responsibility that we humans possess, who must rebuild and reorient our virtues, values and potentialities in such a way that, from the approach that is intended to contribute, we become agents of change. Therefore, I invite the reader to be critical, investigate and make viable the actions that are necessary to modify unjust realities that are even incorporated in the legal systems, in the imaginary collective of society and other environments in which violence is generated, to this should encourage enriching spaces and of course, one of them is the Academy
