dc.descriptionIn the investigation, a study of the procedure under which the contracting of insurance of goods belonging to the public sector operates is carried out based on the legal regulation that imposes on all State entities the obligation to insure their assets, as well as the procedure for the hiring insurance for these purposes. The principles of equality and concurrence are studied from the current regulations, regarding the public procurement of goods and or services (Insurance). The main objective of this work is aimed at demonstrating the deficient regulation that exists in the contracting of this service, since, currently centrally in the contractual stage, inconsistencies and ambiguities are present that impede the materialization of the principles of equality and concurrence of the suppliers recognized in the legislation. It is analyzed what concerns the procedure of acquisition of insurance by special regime and the preference held by the Public Company Seguros Sucre SA within this contracting process, which affects the participation under conditions of equality and concurrence of the other insurance companies in it. In addition, the existing regulatory shortcomings allow the contracting entities to redirect the contracting to a certain insurance company, generating a benefit for this and a limitation of the market for the rest. This means that there must be clear rules that define the parameters and methodology to evaluate potential participants. For the foregoing, a modification to the Organic Law of the National Public Procurement System, its Regulation, Codification of Resolutions and other aspects that reflect the model specifications established for bidding processes for goods and or services (insurance) will be proposed, to protect the public procurement of insurance, respond to the needs of the public sector, and therefore to the service providers. In the methodological field, the research will have a positive critical approach, is qualitative, descriptive, and to develop it, the documentary bibliographic method will be used to study the theory about the subject and the legal exegetical method to examine and be able to propose the pertinente modifications to the current regulations.en
