dc.descriptionIn Ecuador, as in the rest of the world, there are laws that protect disabled people to help them get a job. However, its observed that the law is not fully complied with. This quantitative study analyzed compliance with labor inclusion regulations in accordance with the Labor Code and the Organic Law on Disabilities. Through this research and according to statistical data of the National Council for Equal Disabilities (2019), of all persons with disabilities of working age, only 23 percent have a job. Additionally, only 36 percent of public companies and 57 percent of private companies comply with the percentages of labor inclusion (Ministry of Labor, 2019). When reviewing these figures, the question was: Why do disabled people fail to get stable jobs, despite having an inclusion law that requires employers to hire them? In order to answer this question, we investigated the causes for which, employers dont want or cant hire people with disabilities. In this way, the causes for which the Organic Law on Disabilities and the Labor Code regarding labor inclusion are not complied with were evidenced. Four important legal causes were found that intervene in compliance with the Law. First, there is a legal overprotection for people with disabilities that makes employers vulnerable. Second, there is an ambiguity in the adoption of the legal concept of disability. Third. There is a vacuum in the Law, regarding fines for noncompliance with the percentages, causing employers to choose to take the risk to be sanctioned. Finally, the infrastructure requirements are so high that neither employers nor the State have been able to meet them. This paper concludes that there is no real inclusion for this group of doubly vulnerable people, despite the existence of national and international regulations regarding labor inclusion. A revision of the rules is essential in order to reduce the legal causes that affect their compliance.en
