| Descripción : | The present investigation seeks to analyze if the administrative administrations imposed by the Hydrocarbons Regulation and Control Agency are legally valid, based on the regulatory provisions delegated by law. In this sense, the Constitution of the Republic of Ecuador recognizes the sanctioning power of the Public Administration, in the case of the occurrence of administrative infractions, however, this power is subject to the limits of the reservation of the Law as a constitutional principle concatenated with the principle of legality. The principle of legality in the sanctioning area implies the recognition of the sanctioning power with a norm with a range of law, and that is found in the wording of the legend. |
