dc.descriptionThe development that has taken the Ecuadorian Notary Act has been remarkable. The first law was issued in the year 1966 in which the powers for notaries were limited to four. Since then and for forty-five years the Notary Act has undergone several renovations, but with the enactment of the new Constitution of the Republic of Ecuador and the Organic Code of the Judiciary was changed substantially. What has been done in this paper is a comprehensive analysis and study of the history and development of the notary system in the world to finish focusing on our country, studying the first Notary Act and all its amendments to the present, with this and the study compared to the laws of Peru, Mexico and Chile has made a proposal to reform the Notary Act into force, introducing new provisions of the Constitution, the Organic Code of the Judiciary and incorporating new figures that could be implemented in Ecuador in relation to the Notary Law, in order to have an effective, according to public demanden
dc.description.abstractEl desarrollo que ha tenido la Ley Notarial ecuatoriana ha sido trascendental. La primera Ley fue expedida en el año de 1966 en la cual las atribuciones que se concedían a los notarios se limitaban a cuatro. Desde entonces y durante cuarenta y cinco años la Ley Notarial ha sido objeto de varias reformas, pero con la expedición de la nueva Constitución de la República del Ecuador y del Código Orgánico de la Función Judicial fue cambiada sustancialmente. Lo que se ha realizado en el presente trabajo es un análisis y estudio completo de la historia y desarrollo del sistema notarial desde sus inicios para terminar enfocándonos en nuestro país, estudiando la primera Ley Notarial y todas sus reformas hasta la actualidad; con esto y con el estudio comparado de las legislaciones de Perú, México y Chile se ha efectuado una propuesta de reforma a la Ley Notarial en vigencia, introduciendo las nuevas disposiciones de la Constitución de la República y del Código Orgánico de la Función Judicial; e incorporando nuevas figuras que se podrían poner en práctica en el Ecuador con relación a las prácticas notariales, para así tener un sistema eficaz, de acuerdo a la demanda ciudadana.es_ES
