dc.descriptionIn the Ecuadorian legal system there are two types of divorce, one by mutual consent and another by contentious way. The latter requires the existence and demonstration of a cause for its origin, a situation that has currently brought various problems in cases in which only one of the spouses requests the termination of the marriage bond and the other opposes, among which they find affectations to the physical, psychological, social, emotional and economic integrity of the spouses and, above all, of the minor children, since often before the impossibility of demonstrating a cause that fits the situation of the spouses opt for home abandonment, which sharpens these affectations for the family. In this sense, throughout the present work a study will be carried out on the inefficiency of resorting to the grounds of divorce, in order that any of the spouses can end the marriage bond without the need to resort to the expression of a cause. This type of divorce has already been adopted by other countries such as Spain and Mexico, where it has been recognized that this institute is an aspect of the private life of people in which the State cannot intervene. In Spanish legislation, there is also the theory of the unilateral withdrawal of the marriage contract, which considers that the termination of the marriage bond must be carried out in the same way as the other obligations are extinguished, which would include the possibility of terminating the marriage contract. Marriage through unilateral withdrawal, since the fact that one of the spouses comes before the jurisdiction to demand the termination of the marriage implies the absence of the purposes for which the same has been constituted, and this link may be terminated. Through the analysis of comparative legislation and the current situation in Ecuador, the need to incorporate uncaused divorce into Ecuadorian legislation will be demonstrated in order to guarantee the protection of family rights.en
dc.description.abstractEn el ordenamiento jurídico ecuatoriano existen dos tipos de divorcio, uno por mutuo consentimiento y otro por vía contenciosa. Este último, requiere de la existencia y demostración de una causal para su procedencia, situación que actualmente ha traído diversos problemas en los casos en los cuales uno sólo de los cónyuges solicita la terminación del vínculo matrimonial y el otro se opone, entre los que se encuentran afectaciones a la integridad física, psicológica, social, emocional y económica de los cónyuges y, sobre todo, de los hijos menores de edad, ya que a menudo ante la imposibilidad de demostrar una causal que se ajuste a la situación de los cónyuges se opta por el abandono de hogar, que agudiza estas afectaciones para la familia. En este sentido, a lo largo del presente trabajo se realizará un estudio sobre la ineficiencia de recurrir a las causales del divorcio, al objeto de que cualquiera de los cónyuges pueda terminar el vínculo matrimonial sin que sea necesario recurrir a la expresión de una causal. Este tipo de divorcio ya ha sido adoptado por otros países como España y México, donde se ha reconocido que este instituto es un aspecto de la vida privada de las personas en la cual el Estado no puede intervenir. En la legislación española, además existe la teoría del desistimiento unilateral del contrato de matrimonio, que considera que la terminación del vínculo matrimonial debe realizarse en la misma forma en la que se extinguen las demás obligaciones, lo que incluiría la posibilidad de terminar el contrato de matrimonio mediante el desistimiento unilateral, ya que el hecho de que uno de los cónyuges acuda ante la jurisdicción para demandar la terminación del matrimonio implica la ausencia de los fines para los cuales se ha constituido el mismo, pudiendo darse por terminado este vínculo. A través del análisis de la legislación comparada y la situación actual del Ecuador, se demostrará la necesidad de incorporar el divorcio incausado en la legislación ecuatoriana con el fin de garantizar la protección de los derechos de la familia.es_ES
