Resumen : Preservar la integridad de los derechos del hombre ha sido una noción vital para la creación de organismos y sistemas que velen por este principio...
Descripción : Preserving the integrity of individuals through the protection of their human rights is a notion that has played a critical role in the making of international organisms and systems for the protection of human rights. Pursuant to this objective, the Interamerican Human Rights System (SIDH for its acronym in Spanish) was created in order to protect human rights across the Latin American region. The Colombian and Ecuadorian States have ratified international instruments on human rights, including those under the SIDH. However, this does not necessarily imply that the countries have fully complied. That is why there is a need to analyze and compare human rights indicators during two presidential periods: from 2002-2010 in Colombia under the Ex-President Álvaro Uribe Vélez government, and from 2007-2017 in Ecuador during Rafael Correa Delgado’s presidency. These two periods share a common timeline but, fundamentally differ in their political ideologies: being Uribe a politician from the right and Correa from the left. This provides a broader political spectrum to the juridical analysis of human rights protection under their administrations. For the purposes of this research, two methods will be used: the comparative method, to identify differences and similarities between their administrations and respective foreign politics, and the case study method. Deeping into three case studies will provide clarity on whether the Interamerican Human Rights Court (Court IDH for its acronym in Spanish) sentences were implemented or not. Additionally, a dialogue between authors regarding the historical context of human rights protection in these two countries has been included as part of the document. Finally, the roots of the legal and historical differences between Ecuador and Colombian jurisdiction on human rights will be traced according to their national legal and socio-political frameworks.
