dc.descriptionThe present essay consists in the contextualization of hybrid conflicts in international law. These is a kind of conflict that, due to their own characteristics, have aspects of International Human Rights Law (IHRL) and International Humanitarian Law (IHL). To identify these conflicts, the IHRL is first analyzed. This branch of law aims to limit the actions of the State in its daily tasks through the obligations of respect and guarantee. This legal system applies at all time. This protection is reinforced when the state is in any type of internal tension such as internal disturbances. On the other hand, IHL aims to protect the human being in contexts of armed conflict. This branch of law is activated when the State is immersed in an armed confrontation. For this reason, IHL contemplates different types of conflict, which have specific rules and areas of application. When the internal tension exceeds the sphere of an internal disturbance, but it does achieve the requirements of an armed conflict, there is not a specific set of norms that determine how to protect people. Therefore, in this regard, we can say there is a “legal vacuum” in international law, that comes from the fact that there is no specific law applicable to these type of “hybrid conflicts”. To solve this problem, based on the theoretical aspects of IHRL and IHL, we conclude that the protection in this type of conflicts corresponds to both regimes of law. In other words, in this cases the IHRL must be applied to impose limits on the actions of the State, and the IHL also must be applied through common article 3 of the Geneva Conventions, which contains the minimum of humanity that should be carried during armed conflicts.en
