dc.description.abstractEl peculado desde la lesividad, tutela la res pública y la fidelidad de cumplimiento por el custodio de bienes estatales, lo que debe ser probado en juicio, tanto sus elementos constitutivos, como la responsabilidad penal y sus efectos dañosos que se expresan materialmente en el quantum de la afectación presupuestaria y la violación de derechos que se buscaba resolver a través del presupuesto, por lo que el daño inferido se verifica inicialmente en el ejercicio económico de la ocurrencia del delito y luego se prolonga al constituirse en lastre para el cumplimiento de estos programas y proyectos que fueron afectados y no pueden ejecutarse en tanto no se suscite y sea: a) El pago de la reparación b) La reprogramación y reasignación de fondos por la institución pública para el cumplimiento de derechos, ocasionándose así una afectación y no meramente aritmética. Dependiendo de dónde se sitúe el investigador, en el paradigma del garantismo o el control social, del derecho penal mínimo o el derecho penal máximo, es el tratamiento que se debe dar al delito de peculado. Desde la perspectiva del control social, refiriéndonos a los delitos contra la administración pública, que es donde se encuentra el delito de peculado en nuestra legislación, estos delitos protegen a la Administración Pública, preservando la regularidad de su funcionamiento y la legalidad de los actos administrativos, que pueden verse comprometidas por el acto arbitrario en el que el funcionario actúe más allá de su competencia, por la omisión de su actividad necesaria y aun por la injerencia ilegal de particulares en la esfera de competencia de la Administración.es_ES
