| Descripción : | The essay addresses the legal problem of the incompatibility of article 26 of the Organic Law of Communications, (LOC), with the norms and standards on freedom of expression, to which Ecuador is bound by the ratification of several international instruments that they contain it, in particular, with the American Convention on Human Rights hereafter, (ACHR). The problem arises both from the form and the substance of the aforementioned norm. By the way, it would seem to not obey the requirement of precision and certainty that should be drafted any rule that has the potential to restrict a right. In essence, the media lynching would seem to impede the possibility of openly discussing issues of public interest or the management of public officials, and therefore, would be incompatible with the objectives of any democratic society. In addition, the paper will analyze the apparent conflict that exists between the right to honor, which seeks to protect article 26 of the LOC, and the possibility of freely exchanging ideas and opinions on issues of public interest that affect a democracy, such as of Ecuador. |
